1.FOOD AND BEVERAGE
Apartamentos Balansat-Torremar offer a variety of meal plans. Meals are not included within a room rate. Meal plans must be selected during the booking process. All meals are charged except for infants under 2 years age.

2.CHILDREN POLICY
Children aged 1 year or under may stay free of charge..
Children aged 2-12 years has a 50% reduction in meal plans.
Should you require a cot, please ask at the time of booking.

3.SMOKING POLICY
Apartamentos Balansat-Torremar smoke allowed outside.

4.PET POLICY

Apartamentos Balansat-Torremar. Pets are not allowed.

GENERAL TERMS AND CONDITIONS

The purpose of this document is to regulate the GENERAL TERMS AND/OR CONDITIONS of on-line Reservation services of the company Apartamentos Balansat-Torremar registered  at Puerto de San Miguel s/n, 07815 San Juan-Ibiza, B07-818552. The terms "You" and "User" are used herein to refer to any individual and/or entity that for whatever reason accesses www.balansatresort.com or uses the services.
The use of these services presupposes full and unconditional acceptance and the validity of each and every one of the General Terms and/or Conditions (which shall be deemed to be automatically incorporated in the agreement entered into with Apartamentos Balansat-Torremar without their written transcription therein being necessary) included in the latest updated version of these General Terms and/or Conditions.

1 USE OF THE RESERVATION SYSTEM
On-line Reservation Services are purposed to the Reservation of a room in Apartamentos Balansat-Torremar.

THE USE OF THESE SERVICES PRESUPPOSES FULL AND UNCONDITIONAL ACCEPTANCE AND THE VALIDITY OF EACH AND EVERY ONE OF THE GENERAL TERMS AND/OR CONDITIONS INCLUDED IN THE LATEST UPDATED VERSION OF THESE GENERAL TERMS AND/OR CONDITIONS.

CONTRACT PROCEDURE
Whenever user makes use of the service, user will receive procesing confirmation by email including the information that user's purchase order is in the process of being confirmed. If user becomes a consumer once the total amount or deposit  corresponding to the Reservation has been charged, he or she will receive an email confirming the reservation, which will act as proof of the reservation. Booking will be not confirmed without this proof and a payment proof.

GUARANTEE
The reservation is confirmed and guaranteed all night long with a credit card. If the client fails to show up without prior notice, the first night's stay will be charged (VAT and taxes included).

CANCELLATION OF A RESERVATION
The credit card is just a guarantee. The customer will not be charged of a cancellation fee always provided that cancellation is done before the time established as deadline (at local time of the hotel) on the day of arrival. Once the deadline has been passed, Apartamentos Balansat-Torremar will charge a cancellation fee as compensation.
The cancellation fee of Apartamentos Balansat-Torremar is equal to the price of the first night (VAT and taxes included)
The deadline arrival times at the hotel is: 2 days before arrival day.

RATES AND TAXES

Rates displayed in our website are valid for the period indicated. When justifiable reasons exist Apartamentos Balansat-Torremar reserves the right to amend these rates without prior notice.
The rates relative to a reservation are displayed during the reservation proccess. VAT/TAXES are included in the rates as well as any applicable additional taxes according to local regulations.

2 USE OF WEBSITE SERVICES
User undertakes to make use of the services in accordance with the Law, decency, respectability and law and order and in accordance with the provisions of these General Terms and Conditions. Consequently, user has the obligation of refraining from using the services for illicit purposes and effects and/or contrary to what is established in these General Terms and Conditions, in a manner that may be injurious to the rights and/or interests of third parties or that may in any way harm Apartamentos Balansat-Torremar and/or its image or the services.
For good efficiency and user's benefit, Apartamentos Balansat-Torremar may at any time and without prior warning modify the services provided or the operational, technical or usage conditions of the services. Similarly, with a view to improving the service and establishing an optimum quality level, users are invited to suggest any modifications they may consider useful by contacting Apartamentos Balansat-Torremar.
Personal Data Protection
Users of the on-line Reservation services offered via www.balansatresort.com are voluntarily providing data of a personal type and expressly and unconditionally agree in full to Apartamentos Balansat-Torremar processing them automatically and including them in a file for the purpose of being able to offer and provide their services. This file is the responsibility of Apartamentos Balansat-Torremar.
Due to the characteristics of the Apartamentos Balansat-Torremar services and in order to develop and meet its targets, it may be necessary for these personal data to be ceded to third parties. These personal data may be transferred to companies and/or to other interested parties. The only purpose of the transfer of personal data to these entities is the correct rendering of the services offered by Apartamentos Balansat-Torremar.
At this time, except for when indicated otherwise, user is giving consent such that your personal data may be used by Apartamentos Balansat-Torremar and/or third parties related to the leisure tourism, and hospitality industries, for purposes of advertisement and new business development. These can include the emission of commercial communications through electronic media, in order to measure levels of customer satisfaction.
User may have the option to check/uncheck the newsletters field during the booking process and prior to accepting the general terms and conditions. (do not agree to receive advertisements and commercial information).
Users making available their personal data have the right at all times to access the file and exercise their rights of rectification, cancellation and opposition in accordance with the terms and conditions laid down in data protection legislation. Similarly, user's consent to the processing and transfer of its personal data will be revocable at all times without retroactive effect, as per the provisions of Sections 6 and 11 of Spain's Law 15/1999, of 13th December 1999, of the Protection of Personal Data.
Apartamentos Balansat-Torremar booking services are not to be used by children, therefore Apartamentos Balansat-Torremar neither requests nor collects information relating to children.
www.balansatresort.commay collect information through such devices as cookies or log files on the browsing habits of its www.balansatresort.com users. These devices are associated exclusively with one user and its own personal computer. In these cases, Apartamentos Balansat-Torremar will only use these data as a whole and with the ultimate aim of improving its services.
The electronic document with which the reservation is formalized is archived electronically during the established statutory period. Clients may access data by exercising their corresponding access rights in the aforementioned manner.

3 CORRECT USE OF WEBSITE CONTENT
All material included on this www.balansatresort.com and any other Site owned, operated, licensed or controlled by Apartamentos Balansat-Torremar, such as text, graphics, logos, images and photographs, is the property of Apartamentos Balansat-Torremar  its subsidiaries, affiliated companies and/or third-party licensors and is protected by Spain's and international copyright laws. Modification or use of the Content except as expressly provided in these Terms of Use violates Apartamentos Balansat-Torremar intellectual property rights.
The Content may not be copied, distributed, republished, uploaded, posted or transmitted in any way without the prior written consent of Apartamentos Balansat-Torremar

4 RIGHT TO AMEND THE GENERAL TERMS AND CONDITIONS
Apartamentos Balansat-Torremar reserves the right to amend these General Terms and/or Conditions, informing users of the amendments made via www.balansatresort.com

5 GUARANTEE AND DISCLAIMER

5.1 Apartamentos Balansat-Torremar DOES NOT GUARANTEE THE RELIABILITY, AVAILABILITY OR CONTINUITY OF THE SERVICES MADE AVAILABLE TO USER AND, CONSEQUENTLY, DISCLAIMS ALL LIABILITY FOR ANY DAMAGES AND/OR LOSSES OF ANY TYPE THAT MAY BE DUE TO THE LACK THEREOF. NEVERTHELESS, AND TO THE EXTENT THAT THIS IS POSSIBLE, IT WILL ENDEAVOUR TO MAKE TECHNICAL ASSISTANCE AVAILABLE TO THE AFFECTED PERSON. LIKEWISE, Apartamentos Balansat-Torremar WILL SEEK TO RESOLVE THE INTERRUPTION AND, WHENEVER POSSIBLE, PUT ALTERNATIVE MEASURES AT THE DISPOSITION OF THE USER.

5.2 Apartamentos Balansat-Torremar DOES NOT UNDERTAKE TO CONTROL AND HAS NOT PREVIOUSLY CONTROLLED THE CONTENTS FOR THE PRESENCE OF VIRUSES OR OTHER ELEMENTS THAT MAY CAUSE ALTERATIONS IN THE SOFTWARE OR HARDWARE OF USER OR PERSONS WHO VISIT THE SITE AND, CONSEQUENTLY, IS NOT RESPONSIBLE FOR ANY DAMAGES AND/OR LOSSES OF ANY TYPE THAT MAY RESULT THEREFROM.

5.3 IF, IN SPITE OF ACTING WITH DUE DILIGENCE AND FORESIGHT, Apartamentos Balansat-Torremar IS UNABLE TO PROVIDE THE BOOKED ROOMS FOR REASONS THAT ARE NOT ATTRIBUTABLE TO Apartamentos Balansat-Torremar OR SHOULD IT BE IMPOSSIBLE TO RENDER THE SERVICES UNDER THE AGREED TERMS AND CONDITIONS Apartamentos Balansat-Torremar SHALL OFFER USER THE POSSIBILITY OF CHOOSING BETWEEN A REFUND OF THE TOTAL AMOUNT PAID OR THE SUBSTITUTION OF OTHER ROOMS OF A SIMILAR CATEGORY OR QUALITY. IF, AS A RESULT OF THE SUBSTITUTION, THE SERVICE WERE TO BE OF INFERIOR CATEGORY OR QUALITY, Apartamentos Balansat-Torremar MUST REFUND THE DIFFERENCE.

6 GENERAL SAFEGUARD
Should any of the provisions of these General Terms and/or Conditions be declared null and void or unenforceable, the remaining Conditions shall be maintained in the agreed terms. Apartamentos Balansat-Torremar undertakes to substitute the provision in question by a provision that most closely complies with the intent initially pursued by the parties.
NO PROVISION IN THIS AGREEMENT SHALL IN ANY WAY AFFECT MANDATORY CONSUMER-RELATED REGULATIONS. IF YOU ARE NOT A CONSUMER, YOU EXPRESSLY WAIVE YOUR RIGHT OF ABANDONMENT.

7 ACCEPTANCE OF RULES OF USE
User is aware of the fact that the use of the on-line Reservation services presupposes full and unconditional acceptance of each and every one of the provisions of the Rules of www.balansatresort.com in the version published by Apartamentos Balansat-Torremar at the moment that user contracts the service. Such Rules of Use complete these General Terms and/or Conditions in all aspects that are not in opposition to them. Consequently, user must be aware of the importance of reading the Web Site's rules prior to accessing it and/or making use of the services.

8 APPLICABLE LAW
These General Terms and/or Conditions are governed by Spanish Law. For the settlement of any disputes that may arise in connection with their total or partial validity, execution, compliance or resolution, Apartamentos Balansat-Torremar and user, expressly waiving their own or any other venue that may correspond to them, agree to abide by the jurisdiction of the Courts and Tribunals of Ibiza. This contract constitutes the total and complete agreement between Apartamentos Balansat-Torremar and user and substitutes all previous pacts, undertakings, statements and agreements, whether written or oral, that may have existed previously between both parties.
In any case, any controversy that may arise from the provision of services at the hotel in which the client is staying shall be submitted to the Courts and Tribunals of Ibiza
